Terms and conditions
These terms describe how Claim the Night takes enquiries through claimthenight.com and how a themed entertainment programme is agreed, prepared and delivered.
This document is an informational template. Have it checked by a lawyer in New Zealand before you rely on it.
1. The service provider and the scope of these terms
The service provider is Claim the Night, 385 High Street, Central Dunedin, Dunedin 9016, New Zealand, New Zealand, contactable at [email protected] and +64 3477 04 89. These terms apply to the use of this site, to enquiries sent through it, and to the preparation and delivery of the programmes described on it. Registration details are given in the service provider details.
2. Definitions
- Event - the occasion organised by the client at a venue of the client's choosing, for which we deliver a programme.
- Programme - the activities, crew, equipment and scenography listed with a format in the catalogue, delivered over the stated number of hours.
- Package - one programme at one price, as described on its page in the catalogue.
- Enquiry - a message sent through the form or by email asking about availability and price. It is not a booking.
- Client - the company or adult person who commissions the programme.
- Chip - a prop used in casino-style activities for scoring and atmosphere. It carries no denomination, is not sold, and is not exchangeable for anything.
3. The nature of the service
We provide entertainment programmes delivered in person, at a venue chosen by the client. Casino-style formats are themed activities: hosts set up roulette, blackjack and poker tables and teach the rules at the table.
The service is not gambling within the meaning of the Gambling Act 2003. Chips are props. They are not sold, cannot be bought or topped up, and are not exchanged for money, goods, vouchers or other valuables. No stake of money or property is placed, and the result of an activity gives a participant no financial benefit. There is no online casino, no app and no play over the internet. Participation in casino-style activities is for guests aged 20+. Where a programme includes scoring, any prize is non-monetary and symbolic, such as a printed certificate.
4. Using the site and the form
The site is informational. You may use it to read about the programmes and to send an enquiry. You may not use the form to send unlawful content, to attempt to interfere with the site, or to send automated submissions. We may refuse or delete a submission that appears to be automated or abusive. You are responsible for the accuracy of what you send and for having the authority to send it on behalf of a company.
5. Enquiry and formation of a contract
Sending an enquiry does not reserve a date and does not create a contract. After an enquiry we check availability, discuss the package and the venue conditions, and send a written offer. A contract comes into being, and the date is held, once that written confirmation and the contract are accepted by both sides and the deposit has been paid. Until then the date remains available to other clients.
6. Prices and payment
Prices published on this site are final prices for the whole package described, for the guest limit stated with the format, in NZD and including GST. They are not prices per person. A smaller group does not change the price of a package; a different package has a different price.
Every price includes: the programme, crew and equipment listed with the format; planning, the run sheet and one coordinator on site; transport anywhere in New Zealand; set-up and pack-down outside programme hours; all taxes payable, GST included.
No price includes: the venue itself, with its furniture, power and bathrooms; catering, bar service and drinks; accommodation for your guests; gifts or giveaways for guests; a photographer or videographer.
Payment terms: a deposit of 20-40% once the contract is signed, the balance 5-10 days before the event. Payment is by bank transfer against an invoice, unless the contract says otherwise. Anything the site genuinely requires beyond the standard package, a generator on an unpowered ground for example, is quoted as a separate line before the contract is signed.
7. Preparation and delivery
The venue requirements for each format are published with that format and confirmed in writing before the contract. The client is responsible for: the venue and its booking, the floor area, ceiling height and furniture, power supply of the stated capacity, loading access and parking, bathrooms, any permissions the venue requires, the noise curfew, catering and drinks.
We are responsible for: the programme, the crew, the equipment and the scenography listed in the package, the run sheet, transport, set-up and pack-down, and one coordinator on site for the whole programme. Set-up and pack-down happen outside the programme hours: set-up takes up to 3 hours before the event, pack-down 1-2 hours after.
If the venue turns out not to meet the agreed requirements on the day, we will deliver as much of the programme as can be delivered safely, and the price does not change. We will always tell you in advance if we believe a venue does not work for the format you have chosen.
8. Postponement and cancellation
A request to move the date is considered against our availability; where we are free, one postponement is usually possible and the deposit carries over to the new date. If the client cancels, the deposit covers the planning and reservation work already done, to the extent set out in the contract. If we cannot deliver for reasons attributable to us, we return everything paid, and we will offer an alternative date or a comparable programme.
9. Cancellation rights for consumers
New Zealand law does not give a general cooling-off right for services of this kind, so the arrangements for postponement and cancellation are the ones set out in clause 8 and in your contract, and they are agreed before you pay anything. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply to you as a consumer. Those rights stand whatever the contract says.
10. Complaints
Send a complaint to [email protected] or to 385 High Street, Central Dunedin, Dunedin 9016, New Zealand, describing what happened, when, and what you would like us to do. We confirm receipt within 2 working days and give a substantive answer within 14 working days. If we cannot resolve it between us, a consumer may take a claim to the Disputes Tribunal, within its monetary limits, or to the courts; commercial clients may use the dispute mechanism agreed in the contract.
11. Liability and events beyond our control
We are liable for damage we cause by failing to perform the contract, within the limits agreed in it and within the limits the law allows. We are not liable for the venue, its condition or its decisions, for catering we did not supply, for the behaviour of guests, or for loss caused by information the client gave us that turned out to be wrong.
Neither side is in breach where performance is prevented by something outside its reasonable control: a natural event, a civil emergency, a power failure at the venue, an official restriction, or a transport closure. In that case we agree an alternative date, or settle the amounts actually incurred.
12. Final provisions
These terms are governed by the law of New Zealand, and the courts of New Zealand have jurisdiction. If a provision turns out to be unenforceable, the rest continues to apply. We may update these terms for future enquiries; the version that applies to your event is the one in force when your contract was signed. These terms take effect on 13/10/2026.
