Privacy policy
This policy explains what personal information Claim the Night collects through claimthenight.com, why we collect it, who sees it, how long we keep it and what you can ask us to do with it. It is written for the Privacy Act 2020 and the information privacy principles in it.
This document is an informational template. Have it checked by a lawyer in New Zealand before you rely on it.
1. Who is responsible for your information
The agency responsible for the information collected through this site is Claim the Night, 385 High Street, Central Dunedin, Dunedin 9016, New Zealand, New Zealand. You can reach us at [email protected] or +64 3477 04 89. Enquiries about privacy go to the same address, marked for the attention of the privacy contact.
2. What we collect
Three kinds of information:
- What you send us in the enquiry form: your name, company if you give one, email address, phone number, the format you are interested in, the date, the town or venue, the number of guests, your budget range if you choose one, anything you write in the message field, and the two confirmations you tick about adult participation and the nature of the programme.
- Correspondence: the emails, calls and messages that follow, together with the notes we make to plan an event.
- Technical information: your IP address, the browser and device type reported by your browser, the pages you open and the time you open them, and the cookies described in the cookie policy. Analytics and marketing cookies are only used if you consent to them.
We do not ask for and do not want sensitive information such as health or financial details. Please do not send card numbers or identity documents through the form.
3. Why we collect it, and on what basis
- To answer your enquiry and prepare an event. Without a name, an email address, a date and a location we cannot tell you whether we are free or what the event would cost. This is the step before, and then the performance of, a contract with you.
- To run and protect the site. Technical information and the security measures around the form (the session, the anti-forgery token, the spam checks) exist so the form works and is not abused. This is our legitimate interest in a functioning website.
- With your consent: analytics and marketing cookies, and the optional marketing messages you can tick in the form. You can withdraw either at any time, and withdrawing does not affect anything we have already done.
- To meet legal duties: tax and accounting records relating to events we have actually run.
Giving us your information is voluntary, but if you leave out the required fields we cannot answer the enquiry.
4. Who else sees it
- our hosting provider, which stores the site and the enquiry log on its servers;
- our email provider, which carries the message to us and our reply to you;
- if you consent to analytics or marketing cookies, Google as the provider of those services. Google explains how it handles data on sites that use its services at policies.google.com/technologies/partner-sites and at business.safety.google/privacy;
- our accountant and, where we have to, a public authority entitled to the information;
- a venue or a subcontracted crew member, only where delivering your event requires it, and only the details needed for that purpose.
We do not sell personal information and we do not share it for someone else's advertising. Some of our providers store data on servers outside New Zealand. Where that happens we use providers that commit to comparable safeguards, as the Privacy Act 2020 requires for disclosures outside New Zealand.
5. How long we keep it
- An enquiry that does not lead to a contract: up to 12 months, so we can pick up a conversation that comes back, then deleted.
- An event we ran: the contract documentation for as long as tax and accounting rules require, and in any case while a claim arising from it could still be brought.
- Marketing consent: until you withdraw it, and a record of the withdrawal afterwards.
- Your cookie choice: 180 days from the day you make it.
- Server and enquiry logs: up to 12 months.
6. Your rights
Under the Privacy Act 2020 you can ask us to confirm whether we hold information about you, to give you access to it, and to correct it if it is wrong. You can also ask us to delete it, to stop using it for a particular purpose, to send it on to you in a usable form, or to stop sending you marketing messages. Write to [email protected] and we will answer within the statutory period, in most cases sooner.
If you are not satisfied with how we have handled your information or your request, you can complain to the Office of the Privacy Commissioner, the supervisory authority for privacy in New Zealand: privacy.org.nz.
7. Cookies and analytics
Necessary cookies keep the enquiry form and your cookie choice working. Analytics and marketing cookies are set only after you consent, through Google Consent Mode v2: before you choose, ad_storage, analytics_storage, ad_user_data and ad_personalization are all denied. Every file is listed in the cookie policy, and you can change your decision at any time with the Cookie settings button in the footer.
8. Google and advertising personalisation
If we run advertising and you have consented to marketing cookies, Google may process data about your visit for measurement and personalisation. The two pages that explain this are How Google uses information from sites that use its services and Google Business Data Responsibility. You can also manage personalisation in your own Google account settings.
9. Keeping it safe
The site is served over an encrypted connection. The enquiry form is protected by an anti-forgery token, a hidden field that automated scripts fill in and people do not, and a minimum completion time. Access to the enquiry log and the mailbox is limited to the people who need it, and the log sits outside the public web directory. No system is perfect, so if something goes wrong we will tell you and, where the Privacy Act 2020 requires it, notify the Office of the Privacy Commissioner.
10. Changes to this policy
If what we do with personal information changes, we update this page and change the date at the top. Material changes will also be mentioned on the enquiry page for a period.
